Bad Check Restitution Program
The District Attorney is concerned about the negative impact of bad checks passed to local businesses. Millions of dollars are lost every year by merchants as a result of this ongoing problem. Bad checks affect everyone in terms of higher consumer costs that must be passed on to offset losses, and increased taxes to cover the additional costs for law enforcement and prosecution. In an effort to combat this problem, I have organized the Bad Check Restitution Program to assist local merchants with bad check losses. The primary goal of the program is to obtain full restitution for the victim without adding to the financial burden of the criminal justice system.
First time bad check offenders are given the opportunity to avoid criminal prosecution by attending a mandatory intervention class, in addition to paying restitution. All of this is accomplished without any cost to the taxpayers.

On August 27, 2010 at approximately 10AM the Tewksbury Police Department responded to 35 Lee Street for an individual breaking into the home. An alert witness spotted two suspicious men on Lee Street walking up to homes, appearing to see if anyone was home. It was also reported from the witness that one of the suspects gained entry into 45 Lee Street as well. Both entries were made through basement windows. The phone call from the witness prompted a response from several Tewksbury Police Offices who immediately spotted the suspect running on Lee Street. The suspect was later identified as Joseph Billcliff 26 of 7 Kimberly Drive Kingston New Hampshire. Billcliff fled on foot towards Main St. After a perimeter had been set up, Officer Karen Capuano spotted Billcliff walking down Main St. He was
subsequently arrested and charged with breaking and entering into two homes. The property that was stolen from the two homes was immediately recovered and returned to the owners. Billcliff was additionally charged with two counts of larceny over $250, malicious destruction of property over $250.00 and conspiracy. The second suspect fled the area in a dark green Mazda 626 with New Hampshire Dealer plates. The Tewksbury Police Department knows the identity of the second suspect, but is not releasing that information pending an arrest warrant.

On August 2, 2010, at approximately 9:30 am the Tewksbury Police Department received a call of a suspicious vehicle at 105 Rogers Street. The caller (a neighbor) said that she called after she saw the suspects acting suspicious at the location above. She said that she remember reading a newspaper article in which the Tewksbury Police Department asked all citizens to call if they see any thing suspicious. After sending 2 cruisers, the officers on scene immediately notified dispatch that the house was broken into. This neighbor was able to give a great description of the suspects and the vehicle. The caller had got the license plate of the vehicle and the Tewksbury Police Department immediately put out a BOLO (Be on the look out) to all of our vehicles and the surrounding towns and cities. The vehicle was identified on East Street and we were able to follow it up to Route 93 North. The State Police then joined the Tewksbury Police on the highway to locate and stop this
vehicle. This vehicle then went up on Route 495 and took the exit for Route 28. Eventually Tewksbury Detectives, Lawrence Police, and the State Police were able to apprehend two suspects inside a jewelry store trying to pawn what we believe to be stolen merchandise from the house break. Both suspects were brought back and booked by the Tewksbury Police Department.
Mr. Beaulieu and Mr. Whightman will be charged wit the following offenses;
Chapter 266 Section 18b Breaking and Entering into a Building in the daytime to commit a felony
Chapter 266 Section 30a Larceny over $250 Dollars
Chapter 274/6 (2 Counts) Attempt to Commit a Crime
This case remains under investigation and more charges could follow.

Chief’s Message
This is Chief Tim Sheehan from the Tewksbury Police Department and I have written this message to make the residents of Tewksbury aware of a recent upswing in daytime residential breaking and entering (B&E) throughout the Community. We are asking residents to secure their homes and vehicles when left unattended by locking doors, windows, and activating security systems when possible. We are also asking residents to secure their valuables out of plain view in both their residences and their vehicles. Lastly, we are asking residents to assist us by reporting any type of neighborhood suspicious activity observed, such as suspicious individuals and vehicles, no matter how insignificant you feel it may be. A partnership between the residents of Tewksbury and the Tewksbury Police Department is imperative in our plight to reduce this type of

National Night Out
The Tewksbury Police Department would like to announce that they will be participating in the 2010 National Night Out- America's Night Out Against Crime. The event, which intends to strengthen the relationship between the Community and the Police Department, will take place on Tuesday, August 3, 2010, from 6-9PM at the Tewksbury Senior Center (see attached event flyer). We are encouraging residents of all ages to come out to meet members of the Police Department who will be providing child identification kits, child passenger safety information, and bike helmet safety information. In addition, representatives from Tewksbury Fire Department's SAFE program, Tewksbury CARES, as well as local community outreach programs such as Elder Services of Merrimack Valley, WIC, Rape Crisis Center of Greater Lowell, Alternative House Inc., will be
present with educational information on topics that include drug abuse awareness education, elder abuse, domestic violence, and bullying prevention and will be available for questions throughout the evening.

On July 27, 2010, at approximately 9am, Sergeant Walter Jop III responded to an alarm call at 330 North Street. Sergeant Jop III had been patrolling this area of town due to some of the recent breaks in that area, and arrived on scene very quickly and observed a vehicle in the drive way. Sergeant Jop III observed someone in the driver’s seat and began his investigation. During this investigation Officer Capuano and Sergeant Jop III both observed that someone had made forced entry into the residence and had ransacked the inside looking for valuables. Officer Capuano and Officer Welch found a set of keys on the bedroom floor that did not match any of the registered vehicles of the home owner. Sergeant Jop III immediately secured these keys and after further
investigation found the keys belong to the suspect’s car. He also found some of the stolen merchandise from the house break in the vehicle of the suspect. After speaking with the home owner, Sergeant Jop III immediately arrested Mr. Rost. Mr. Rost will be arraigned today at Lowell District Court on the charges below.

Armed Home Invasion & Robbery

The Tewksbury Police Department has arrested two individuals in connection with an Armed Home Invasion on May 16, 2010. This incident involved two masked men who forced their way into a family home and one of these men was armed with a handgun. The man with the handgun demanded money from the victim and fired one round into the wall behind the victim. After intense investigation the Tewksbury Police Detectives apprehended Ryan Corson and Richard Sturtevant with the assistance of Lowell Police Department. Both Subjects will be arraigned in Lowell District Court for the following Charges:

On May 16, 2010, the Tewksbury Police Department responded to the residence located at 212 Beech Street for a reported Armed Home Invasion and Robbery. The victim, Zachary Brown, reported that at approximately 12:30AM two men forced their way into his family home. Both suspects were wearing masks and one of them was armed with a handgun. The armed suspect demanded money from the victim and fired one round into the wall behind the victim. The suspects made off with an undisclosed amount of cash, personal property, and prescription medication. The armed suspect is described as a 5’10”-6’ white male weighing 180-200 lbs. The other suspect is described as a tan skinned male approximately 5’4”-5’6” weighing approximately 200 lbs. Massachusetts State Police Crime Scene Unit was called to
the scene to recover both physical and ballistic evidence. A canvas of the neighborhood was also performed. No vehicle information was ascertained. The Tewksbury Police Detective Division is conducting an active investigation into this incident.

Bank Robbery
Date: April 27, 2010
The Tewksbury Police Department responded to the Lowell Five Cent Savings Bank, located at 10 Main Street (Stadium Plaza), for a bank robbery at approximately 12:15 PM today. The caller stated that the suspect passed a note and made off with an undisclosed amount of cash. The suspect is described as a white heavy set male approximately six feet tall. The suspect was wearing clear latex gloves, a fake beard, a cowboy hat, glasses, jeans, a tan jacket, and white sneakers. The suspect approached a teller and passed a note which indicated “I have a gun, $25,000 now, 15 seconds, I will kill you”. The suspect then loaded an undisclosed amount of cash into a dark colored bag and left the Bank. The suspect was last seen headlining toward Clark Road. The Tewksbury Police Department arrived immediately, set up a perimeter, and began
a search for the suspect. Lowell Police also arrived on scene to assist with the search of the suspect. After a thorough search of the area involving Tewksbury’s K-9 Team and officers from both communities, the suspect was not located and is still at large. I have provided still photos of the suspect above. There was no vehicle information ascertained at the scene. The Tewksbury Police Detective Bureau is still investigating all leads and information pertaining to this case. Please be advised that the Tewksbury Police Department received a 911 Call at 6:10 AM on Sunday April 11, 2010, for a shooting incident that was ongoing at the IHOP Restaurant located at 95 Main Street. Responding Officers took two males into custody and located a handgun at the scene. An ensuing investigation concluded that the two males in custody walked into the IHOP Restaurant at approximately 6:05 AM and initiated a confrontation with a group of Asian males. The altercation became physical (punches being thrown) inside the Restaurant and spilled out onto the sidewalk outside of the Restaurant. It was at that point that one of the two males in custody brandished a
firearm and fired it in the direction of the Asian males. A scramble then ensued followed by a number of other shots being fired. At this time, it appears that no one was struck by the shots that were fired. A large scale investigation is under way but a preliminary investigation indicates that the shooting incident is gang related. The two subjects in custody and the proffered charges are listed below.

During the first two weeks in April, the Tewksbury Police Department conducted a multi-day narcotics investigation at the Motel Caswell. After conducting several days of surveillance and confirming information received that multiple drug transactions were taking and had taken place out of room # 234 at the Motel Caswell, Tewksbury Police Detectives were granted a search warrant to look for narcotics and distribution evidence in room # 234.
On April 8, 2010, Tewksbury Police Detectives executed a search warrant at the Motel Caswell (room # 234) and apprehended two suspects. Rafael Neives (37) and Brenda Jutras (41), both of whom listed the Motel Caswell as their residence, were arrested and charged with possession of heroin with the intent to distribute, possession of cocaine with the intent to distribute, and conspiracy to violate the drug laws. In addition, Neives had an outstanding arrest warrant for possession of cocaine with the intent to distribute from a previous incident that occurred in Tewksbury at the Motel Caswell.

On March 19 2010, the Tewksbury Police Department conducted two undercover surveillance operations. The first operation was conducted at the Motel 6. After conducting surveillance and confirming a drug transaction had taken place, Officer’s apprehended Peter Marquez 23 of 10 Brookfield Street Lawrence MA and Luis Sanchez 20 of 1500 Theiriot Avenue Bronx NY, for Distributing Drugs, Class A (Heroin), Possession with the Intent to Distribute Class B (Crack Cocaine) and Conspiracy to Violate the Drug Laws.
The second operation began at the Wal-Mart parking lot. Undercover Officer’s pre-arranged a meeting with a drug distributor who led them to Jodi Drive in Tewksbury. Once the undercover Officer’s were alerted that the drug transaction had taken place, Officers stopped the suspected vehicle and arrested Roberto Nieves-Alicea 32 of 23 Grace Drive Nashua NH and Juan Ayala 42 of 52 Farnham Street Lawrence MA., for Distributing Drugs, Class A (Heroin), Subsequent Offense and Conspiracy to Violate the Drug Laws.

United States Attorney Carmen M. Ortiz and Steven Derr, Special Agent in Charge of Drug Enforcement Agency-Boston Field Division, announced today that the United States Attorney’s Office has commenced a civil forfeiture proceeding against a Tewksbury, Massachusetts property used to facilitate the trafficking and distribution of illegal narcotics, including heroin, cocaine, methamphetamine and marijuana.
The United States alleges that 434 Main Street (operated as the Motel Caswell) has been used to facilitate that distribution of illegal narcotics in the Tewksbury area since at least 2001. Investigations into drug activity at the property over the past eight years have included a number of controlled and undercover purchases of illegal narcotics (including heroin and cocaine) at 434 Main Street, as well as the investigation of a methamphetamine laboratory being run from one of the rooms at 434 Main Street. These investigations led to the execution of three search warrants, the seizure of drugs and drug distribution and drug manufacturing paraphernalia, and the arrests of various residents of the property.
“This forfeiture action stems from the unprecedented coordination by both federal and local law enforcement to take significant steps toward protecting our communities from the trafficking and distribution of illegal narcotics,” said U.S. Attorney Carmen Ortiz.
“Businesses used to facilitate drug trafficking are a blight in our communities. These drug dens hurt our citizen’s quality of life and will not be allowed to operate in our neighborhoods. Working with the Tewksbury Police Department and the United States Attorney’s Office we were able to seize the Motel Caswell” said Special Agent in Charge Steven Derr.
The case was investigated by the Drug Enforcement Administration and the Tewksbury Police Department. It is being prosecuted by Assistant U.S. Attorney Sonya A. Rao of Ortiz’s Civil Division.
TRAFFIC ALERT: I-495 LOWELL BRIDGE BUNDLE PROJECT LANE SHIFTS, RAMP CLOSURE
Cross-Over Lanes, Temporary Closure of Northbound Exit Ramp
Lowell, MA – Temporary traffic lane shifts and closure of the northbound exit ramp at the Woburn Street interchange in Lowell begin Saturday, November 7, 2009 as part of the I-495 Lowell Bridge Bundle project. The changes should be fully implemented by Monday, November 9 assuming favorable weather conditions and will remain in place for approximately seven months. The MassDOT Highway Division recommends drivers allow extra time for trips through the work zone.
Temporary cross-over lanes beginning south of the Concord River Bridge and ending north of the I-495 Woburn Street interchange in Lowell will shift traffic from the northbound high speed lane across the median and continuing north along a former southbound lane before shifting back. A concrete barrier will separate traffic traveling in opposing directions. An overview of the cross-over lane shift is available on the project website:
The I-495 northbound ramp at the Woburn Street interchange, exit #37 will be closed. Drivers will be detoured to the Route 38 interchange, exit #38, cross under I-495 and return to the Woburn Street interchange using I-495 southbound. Traffic signals at the Route 38 interchange have been adjusted and a temporary traffic signal added at Woburn Street to handle additional detoured traffic. Temporary signs and Variable Message (VMS) Signs will alert drivers to the changes and detour route.
Large trucks will be prohibited from using the temporary traffic lanes except during specific, nighttime construction when all northbound traffic is directed into the temporary lanes.
The replacement of the six bridges in the I-495 Lowell Bridge Bundle is taking place under the Patrick Administration’s historic Accelerated Bridge Program, an eight year, $3 Billion plan to repair structurally deficient bridges throughout the state. The lane shifts and ramp closure will allow the project team to launch the first major phase of bridge work. Bank Robbery
On Monday, October 19, 2009, at approximately 10:45am, members of the Tewksbury Police Department responded to a reported bank robbery that occurred at the Lowell 5 Bank located at 10 Main Street.
A call came in from the Lowell 5 reporting a bank robbery in progress at 10 Main Street. The suspect, a white male approximately 25-30 years old with brown hair, wearing a black sweatshirt, gray pants and carrying a black brief case, left the building on foot towards Clark Road.
